an illegal eviction and an illegal foreclosure
A previous blog talked about the fact that I was subject to an illegal eviction on three houses that I owned in Cambridge,Ontario.But I was also subject to three illegal foreclosures.If you are trying to get rid of someone and he is paying his mortgages then this would take a long time to get rid of him.A proper foreclosure should have the mortgage holder behind three months in his mortgage payment and then is still entitled to a "period of grace".So it is quicker to have him evicted.However once the person is evicted you still need to get a foreclosure in order to remove all his household equity.I was subject to an illegal foreclosure once I was evicted.
A proper foreclosure requires a Notice of Foreclosure.None was given to me nor to my lawyer.This is also a process that must be contested in court.The plaintiff is even required to make a Statement of Claim.None of this was done and this foreclosure was never before the Ontario Superior Court of Justice.In fact, the power of sale transaction was done six weeks after the illegal eviction.
These illegal procedures allowed for the change of ownership within six weeks and me to get no "consideration" for my three houses.Here ,in Cambridge, Ontario is how I lost about $350,000 in equity in two months.
