After I had talked to Jim Barber about the problems with the Order of Dismissal(but had not yet shown him) and had gone to jail in Scarborough for ninety days I decided to garnish the city of London's assets and force them to pay me.I went to the Hamilton court where my claim was and was told to deal with one particular court clerk - her name was Rebecca Hallinski (an Ukranian girl) and I did so.First I decided on the amount of the garnish.On my motion in London I had requested postjudgement interest.I concluded that my motion was valid and so I included postjudgement interest in my garnish.I used 4% and the amount of my garnish was now $4.5 million because of the time and the compounding.I asked Rebecca if this was correct and she said it seemed proper.
I went to Toronto and got the proper Notice of Appeal and a Certificate of Appeal. I got them sworn and served them on the mayor's office and the city solicitor.I asked Rebecca if the Notice of Appeal had to go to court or if it could be done administratively.She said that she could swear it;she did so and I served it on the mayor and London city solicitor.Next I got the Garnishee Statement which I found very complex and filled out the details.It was a four or five page document and took me several tries before it looked suitable.I took it into Rebecca and got it sworn and filed.All my documents were filed in the Hamilton court.Now Rebecca told me that I only needed the garnish fee and my garnish was in effect.This process had taken me about four months but now I was finally going to be done.I saved the necessary fee in the next month and went in to pay it and get my garnish.This time Rebecca was not there and I was directed to another booth.This girl told me that I had no garnish because I didn't go to court for my Notice of Appeal;it could not be done administratively.Then she told me that all my papers were useless without the Notice of Appeal.I told her that it was clear that the Motion for Summary Judgement was illegal.She said that's what you tell the judge at the Notice of Appeal hearing.In total with the trips to Toronto for forms and trips to London I had just spent $1000.
